Partner Noah Cohen Wins False Arrest, Malicious Prosecution Trial in Federal Court

Weir Greenblatt Pierce is pleased to announce that Partner Noah Cohen secured a verdict for his client, Wali Rahman in the United States District Court for the Eastern District of Pennsylvania. The jury found Philadelphia Police Officer Daniel Leone liable for False Arrest, Malicious Prosecution and First Amendment Retaliation in the amount of $170,000 plus fees and costs of $56,998.49 for a total award of $226,998.49.

Mr. Rahman was arrested by Officer Leone after colliding with him while riding his patrol bicycle on the sidewalk at Fifteenth and Chestnut Streets in Philadelphia. Based upon Officer Leone’s statement, Mr. Rahman was then charged by the Philadelphia District Attorney’s office for Aggravated Assault on a police officer. In the criminal case, Mr. Rahman was represented by Isaac Smith and Marit Anderson from the Defender Association of Philadelphia who secured a not guilty verdict.

Mr. Cohen stated: “This verdict goes well beyond finding Mr. Rahman not guilty. The jury found there was no probable cause to arrest Mr. Rahman. I am extremely happy for my client both because it vindicates him entirely and because he will be properly compensated for the trauma he went through, and this heinous violation of his rights.”
